Any conversation about fiduciary duty naturally includes its most critical component: putting the best interest of the client first. What is often overlooked is the requirement to demonstrate procedural prudence, the second-most critical element.


“Simply stated, it’s documenting the details of the decision-making process,” says Donald Trone, founder of the Foundation for Fiduciary Studies and the lead developer of the 2010 Fiduciary Standard.
